逼車追逐撞死人　男二審判刑7年2月

【劉昌松／台北報導】桃園張姓男子今年3月開車時，因行車糾紛，竟不斷超車、追趕1名機車騎士，結果因前方一處路口紅燈，張煞車不及，從後方追撞騎士，騎士因肝臟破裂送醫不治，高院今天依傷害致死罪判張男徒刑7年2月。本案還可上訴。

判決指出，張男今年3月27日一大早，開車行經桃園市三民路時，懷疑遭邵姓騎士騎車擦撞，張驅車上前擋住邵的去路，邵男見苗頭不對閃開後繼續往前騎，張因此心生不滿，從後方追趕到成功路口時，因號誌轉紅燈，邵男不得已減速，張則煞車不及撞上，造成邵男慘死。

桃園地院認為張雖無撞死人的故意，但只因行車糾紛就追逐攔阻邵男，造成邵男傷重死亡，依傷害致死等罪判刑7年2月，張不服上訴，今天仍被高院判處相同刑度。
